ADU Permits, the Pre-Approved Plan and the Ojai Desk

Inside the city, permits run through the Ojai Community Development Department at City Hall, 401 S. Ventura Street. An ADU that meets the city's objective standards and design criteria is approved ministerially by the Community Development Director, no hearing. Miss them and the unit goes to a discretionary Design Review Permit. The counter takes submittals weekdays 8 to 5, plan sets folded to letter size, and an incomplete package is turned away rather than reviewed. County parcels go to Ventura County RMA Planning and County Building and Safety instead.

Ojai publishes one free pre-approved detached plan: a one-bedroom at 499 sq ft by Design Path Studio, downloadable from the city's ADU plans PDF, drawn in three exteriors, Ranch, Spanish and Traditional, each with or without a porch. Roof, trim, wall and window colors must match the main house. The title sheet also asks for a site plan, a Title 24 report, grading and flood-zone checks, a fire-zone checkbox, a choice between a new sewer connection, the existing lateral or existing septic, and a PV system operational before final inspection. State law sets the clock as of 2026. The city has 15 business days to confirm in writing that the application is complete and list anything missing; miss that window and it is deemed complete. From a complete application the city has 60 days to approve or deny, or the unit is deemed approved. A detached unit from the pre-approved plan gets a 30-day decision. Size follows the state ceiling: a detached ADU tops out at 1,200 sq ft, tied in the city's digest to lot size and site conditions, an attached unit at half the house's floor area, and conversions have no cap. HCD's October 8, 2025 letter found Ojai's ADU ordinance on file dated from 2023, listed every state change since and asked for a response by November 7, 2025; where the 2023 text conflicts, state standards apply.

A garage conversion or an older guest house keeps its setbacks, needs no replacement parking, gains up to 150 sq ft for an entry under state law, and skips the sewer capacity charge. Outside the city, septic replaces sewer. A 2011 study counted about 2,100 parcels on septic in Meiners Oaks, Oak View and other valley communities outside district lines; a state-funded OVSD program is moving roughly 160 properties in Casitas Springs, Trusty Lane and North Rice Road onto sewer at no cost to owners. Does the 2025 fire map change how an ADU gets built in Ojai?

On a mapped parcel, yes. CAL FIRE released new Fire Hazard Severity Zone maps for the city and the unincorporated valley on March 10, 2025, and the Ventura County Fire Protection District adopted them effective July 1, 2025. The foothills toward Nordhoff Ridge, Shelf Road, Upper Ojai and the East End groves are the parcels to check on the Ojai Valley Fire Safe Council map. In a Very High zone the unit goes up under the California Wildland-Urban Interface Code (formerly Chapter 7A), which governs roof class, vents, siding, eaves and the first five feet of ground, and the city's pre-approved plan adds sprinklers on any parcel in that zone.

Can I rent out my ADU in Ojai?

Yes, as long as each stay runs more than 30 days. Ojai bans short-term rentals citywide: Resolution 16-07 confirmed the ban in 2016, rentals of 30 days or less are illegal in residential and village mixed-use zones, only hotels, motels and bed-and-breakfasts are exempt, and advertising a unit for shorter stays draws warnings and citations from Community Development. No owner-occupancy rule applies to a standard ADU, so a non-resident owner can build and rent one; a JADU sharing a bathroom with the house is the exception. Tenants come from the valley's hospitality and retail workforce or a family placing a parent close by.

Can my HOA stop me from building an ADU in Ojai?

No. Civil Code 4751 makes any CC&R provision that prohibits or unreasonably restricts an ADU or JADU on a single-family lot void and unenforceable, and Civil Code 714.3 applies the same rule to deed covenants outside an association; since AB 130 took effect in mid-2025, 714.3 also says a reasonable restriction cannot include fees or other financial requirements. HCD's October 2025 letter reminded the city that HOA review cannot be a condition of city approval either. What a board keeps is objective architectural review, and in Ojai the city already requires the unit's roof, trim, wall and window colors to match the house, so one package usually answers both reviewers.
